Terms and Conditions:

1. Information on how to enter and the prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
2. The promoter is Roche Diabetes Care Australia Pty Limited (RDCA) at 24 - 32 Lexington Drive, Bella Vista, NSW 2153
3. Entry is only open to Australian residents aged 18 years or over who have purchased or received an eligible Accu-Chek blood glucose meter. (“Eligible Entrant”). Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin. You warrant that you are eligible to participate if you take steps to participate in this promotion.
4. This promotion commences on 3/01/2017 and final entries close at 11.59pm AEDST on 8/12/2017 (“Promotional Period”).
5. This promotion will be advertised within email correspondence sent to those who have registered their email with RDCA.
6. To enter, Eligible Entrants must, during the Promotional Period, click the “enter to win” button included within the email correspondence sent to the Eligible Entrant from RDCA.
7. The Promoter reserves the right, at any time, to verify the validity of entries and Eligible Entrants (including an Eligible Entrant’s identity, age, occupation, employment status and place of residence) and to disqualify any Eligible Entrant who is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions will be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
8. Only one (1) entry is permitted per Eligible Entrant.
9. If there is a dispute as to the identity of an Eligible Entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the Eligible Entrant.
10. The draw venue is Roche Diabetes Care Australia Pty Ltd, Building E, Level 1, Street no.24-32 Lexington Drive, Bella Vista, NSW, 2153. The winners will be notified by email and telephone and will appear on www.accu-chek.com.au after the draw on the same day as the draw being 10 April 2017, 10 August 2017 and 11 December 2017.
11. The Promoter’s decision is final and no correspondence will be entered into.
12. This is a game of chance winners will be determined at random.
13. Each winner will receive an Apple iPad mini 2 WiFi, silver, 32GB valued at $369 each
14. Any ancillary costs associated with using the iPad are not included.
15. If for any reason a winner does not take their prize at the time stipulated by the Promoter, then their prize will be forfeited.
16. If any prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification.
17. Total prize pool value is $1,107. Prizes are not transferable or exchangeable and cannot be taken as cash.
18. Each prize will be drawn on a separate date; 10/04/17, 10/08/17, and 11/12/17. All draws will take place at 12:00 PM (AEDST)
19. In the event of a re-draw, this will take place at 12:00 PM (AEDST) on 11/03/18.
20. The winners will be notified by email and telephone and will appear on www.accu-chek.com.au after the draw on the same day as the draw
21. Eligible Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
22. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law
    1. to disqualify any Eligible Entrant; or
    2. to modify, suspend, terminate or cancel the promotion, as appropriate.
23. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
24. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of:
    1. any technical difficulties or equipment malfunction (whether or not under the Promoter’s control);
    2. any theft, unauthorised access or third party interference;
    3. any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;
    4. any variation in prize value to that stated in these Terms and Conditions;
    5. any tax liability incurred by a winner or Eligible Entrant;
