Terms of Sale
This terms of sale, together with the documents referred to in it set out the terms and conditions on which a guest or a registered user may make use of websites provided by Roche Diabetes Care Australia Pty Limited (“Roche”, “we”, “us”, or “our”). Use of our site includes accessing, browsing, or registering to use our site (“Accu-Chek shop”).
The purchase of Accu-Chek product(s) through the Accu-Chek shop is subject to availability. Should a product be out of stock, Roche will notify you as soon as possible and will not process your order. Roche can impose order restrictions on the number of products ordered and the interval at which subscription products can be ordered.
Your Accu-Chek product(s) will be delivered as soon as possible and in any event within 30 calendar days of Roche accepting your order. Your Accu-Chek product(s) will be delivered to you by a courier engaged by Roche. Delivery charges will be added to the total order amount once the delivery service has been selected.
Roche will deliver your Accu-Chek product(s) to the delivery address as provided in your order. As purchaser it is your responsibility to ensure all order particulars and address details are correct. Should an order be undelivered due to an incorrect address, Roche will not assume responsibility.
You will be responsible for the Accu-Chek delivery when it has been delivered to you, it is your responsibility to check the delivery contents. Should there be an order discrepancy i.e item missing, damaged packaging, ensure you contact Roche within 7 business days of receiving your delivery. It will be assumed that your delivery is correct if you have not made contact to Roche within this timeframe.
Our goods and services come with guarantees as described in the document inside the product’s packaging that cannot be excluded under the Australian Consumer Law. For Warranty Registration please visit warranty registration page
For major failures with the service, you are entitled:
- to cancel your service contract with us; and
- to a refund for the unused portion, or to compensation for its reduced value.
You are also entitled to choose a refund or replacement for major failures with goods. If a failure with the goods or a service does not amount to a major failure, you are entitled to have the failure rectified in a reasonable time. If this is not done you are entitled to a refund for the goods and to cancel the contract for the service and obtain a refund of any unused portion. You are also entitled to be compensated for any other reasonably foreseeable loss or damage from a failure in the goods or service.

Suspension and termination

Failure to comply with these terms constitutes a material breach of the terms of website use set out above upon which you are permitted to use our sites, and may result in our taking all or any of the following actions:
- Immediate, temporary or permanent withdrawal of your right to use our sites.
